| 摘 要： | 不作为犯罪中的义务是一种积极的具有特殊的适用范围的义务。就该类犯罪中作为义务的来源众说纷纭。不作为犯罪中的义务来源于法律明文规定的、职业或职务道德上要求产生的、基于法律行为产生的、先行行为引起的等法律义务。
