| 摘 要： | 先进文化是综合国力的重要标志。中国的先进文化理所当然地应当包括中国的先进法律文化。先进法律文化的构建,离不开法学研究的繁荣,及其在法学理论指导下的制度创新。但当前法学研究的现状和制度变革不能适应法律文化创新的需要。建设中国先进的法律文化,必须进行原创性的创新,而一切原创都应以本国的实践为基础。简言之,就是学习国外一切有益的法律理论、借鉴甚至移植国外先进的法律制度和法治经验的同时,必须做到两点:一是面对传统,二是面对中国改革开放和法律实践活动所提出的问题。

| Abstract: | Advanced culture is an important symbol of the Comprehensive national strength.The advanced Chinese culture undoubtedly includes the advanced legal culture.The construction of advanced legal culture needs the prosperity of legal research and the system innovation under the guidance of legal theory,while the current situation of legal research and system innovation cannot adapt to the need of innovation of legal culture.The original innovation based on the domestic practice is essential for the construction of Chinese advanced legal culture.In brief,it is indispensable to face the tradition and problems arising out of the reform and opening and legal activities together with learning any useful legal theory and using for reference or even transplanting foreign advanced legal system and experience of rule of law. |
