构建多元化刑事简易程序研究

我国目前对简易程序的理解还停留在狭义的简易程序阶段,即认为简易程序就是简易审判程序.同时,从总体上来看,我国的刑事简易程序设置形式单一,处理案件能力受到限制;从我国现行的简易审判程序来看,制度本身的缺陷及配套设施的不够健全导致了刑事简易程序的利用率不高,违背了简易程序设立的初衷.现在我国正在着手修改刑事诉讼法,利用此契机,完善我国的刑事简易程序,构建多元化的刑事简易程序体系,有利于解决日益增多的刑事纠纷,也有利于满足现代社会和当事人在利益、价值观、偏好和各种实际需要等方面的多元化需求,使司法更加顺应民意,接近正义.

Research on Structuring the Plural Criminal Summary Procedure

Firstly,people remain at narrowly-defined stage to the understanding of the summary procedure that the summary procedure is the simple and easy judicial procedure at present in our country.Secondly,in general terms,because our country's criminal summary procedures have only one type,the ability of handling cases is restricted.Moreover,according to our country's current simple and easy judicial procedure,the defect of system itself and the lack of supporting facilities cause the utilization ratio of the criminal summary procedure are not high.These have violated the original intention of setting up the summary procedures.Our country is setting about revising the criminal procedure law now,utilizing this opportunity to perfect the criminal summary procedures of our country and structure the plural criminal summary procedures system,which will help to solve the increasing criminal disputes as well as meet the plural demands of modern society and parties in the aspects of interests,values,partialities and various needs etc.These will make the administration of justice comply with the will of the people further and approach to justice.
