| 摘 要： | 尽管近年来，学界倡导弱化口供在刑事诉讼中的地位，甚至要求赋予被追诉人沉默权，但从司法实践来看，刑事诉讼中口供的中心地位并未改变，侦查人员头脑中仍然存在“口供情结”，究其原因，与口供在刑事案件中所起到的作用、侦查资源和技术供给的不足、现行考核机制的压力、社会日常监控的不足等因素有着密切关系。
