行政合同中的价值悖论与释然

行政合同是在近现代民主思想的影响下产生发展起来的，是一种较柔性的行政管理方式。它是权力因素和契约因素相结合的产物。行政合同中所体现的权力和契约的双重性造成了价值上的悖论，但是这两种价值并非根本上的对立冲突，而是可以互补相融的，形成一定程度中的释然。

Value Paradox of Administrative Contract and its Integration

Administrative contract is becoming a flexible administration manner effected by modern democratic think-ing in modern society,and it is the result of integration of authority factor and contract factors.Administrative contract re-sults in paradox value under the traditional understanding because of its two characters of power and contract.But these two values of administrative contract are not fundamental confilcts,they can exist together.
