网上证据新论

网上证据是近年来诉讼中经常出现的新的证据表现形式,通过对我国传统证据分类方法、科技发展以及法律稳定性等因素的分析,提出网上证据和视听资料是电子证据的不同表现形式,立法上应当确立电子证据的独立证据地位,取消视听资料作为独立证据类型的做法。针对网上证据的特点,从当事人、法院和中立第三方三个方面论证如何收集合法有效的网上证据;以及如何从关联性、合法性和真实性三个方面认定网上证据的效力。
