摘    要:无论从当下的现实诉求出发,运用实证分析工具对人事保证合同予以研究抑或对劳动权权利谱系予以解读和对劳动权予以价值分析,都会产生同样的结论:现阶段,我国《劳动合同法》不应该移植人事保证制度,并对其作规范化、模型化、体系化建构;并且在其合同效力的合法性上,现行法律应持否认态度。

Abstract:Whether starting from the demands of immediate reality, using empirical-analysis to research the contract of personnel. guarantee or to interpretate the genealogy of labor rights and to value-analysis of the labor right, will have the same eonclusion: China's "Labor Contract Law"sbould not transplante persconels assurance system and subject to the construction of standard- ized, model-based, system-oriented; and existing laws shoald have an denial attitude on the legality of contract effectiveness.
