| 摘 要： | 非法证据的取舍问题无论是在诉讼法理论界还是在司法实务中都是争论的焦点。在借鉴国外有关非法证据制度的基础上,本文指出我国解决这一争议的关键应以“价值权衡”理论为依据,并结合对非法证据的理性思考,来寻找符合我国国情的非法证据处理模式。

| Abstract: | Whether accept the illegal evidence or not is always the focus in the procedure law circle and the judicial practice circle. To solve this dispute, this essay, in reference to the illegal evidence rules of foreign countries, points out that China should base on the Evaluation Theory in combination with rational consideration of the illegal evidence to set out a mode of dealing rules of illegal evidence according to its real situation. |
