审视与借鉴:俄罗斯联邦的继承制度

早在20世纪50年代,我国的民事立法无论在立法模式上,还是在立法内容上,均借鉴了原苏联的民事立法体例。对原苏联民事立法体例的借鉴,不仅源于政治追求的接近,也源于地理位置和经济模式的接近。进入21世纪后,伴随经济体制的改革,《俄联邦民法典》继承编进行了修正与完善,体现出继承制度建构在路径上的流畅性、内容上的适用性、体系上的严谨性。上述立法特色无疑对《中国民法典.继承编》的建构具有启示和借鉴,并将对我国继承立法在遗嘱形式的选择、特留份制度的完善、遗嘱执行制度的充实产生积极的影响。
