试析两岸关系中的“治权”概念

目前“治权”概念具有模糊性。它是政府的统治权力，既不同于自治权，亦不同于管辖权。在一个主权之下，是否可以存在多个治权，既缺乏充分的理论论证，也没有充足的国际实践作为支撑。对于台湾当局“互不否认治权”的提法，大陆宜慎重处置。

A Research on the Concept of ＂Governing Authority＂ in Cross-Strait Relationship

There is considerable ambiguity about the concept of ＂governing authority＂. It is the power of government but different from autonomy and jurisdiction. It is neither lack of sufficient theoretical arguments nor enough international practice to support the idea that there could be multiple governing authorities in a sovereign country. For the formulation ＂mutual non-denial of governing authority＂ advocated by the Taiwan authorities, the mainland should treat it with great care.
