金融检察参与治理民间融资机制研究——以检察权介入为视角

民间金融长期处于法律法规调控的灰色地带。伴随着民间融资的迅猛发展,非法集资犯罪活动也日益突出,界定合法融资和非法集资出现了理论认定和实践操作的难题。为了规范民间金融,检察机关需要发挥金融检察职能,以一个开放、科学、合理的监管方式介入,以保障和促进民间金融的良性发展。

Research into the Mechanism of the Financial Prosecutors’ Participation in Managing the Civilians’ Financing--From the Perspective of Procuratorate Authority’s Involvement

Civilian ifnance has long been in the grey belt of management by laws and regulations. With civilian ifnancing developing fast, the illegal collection of funds has become increasingly serious. To deifne legal ifnancing and illegal ifnancing has become theoretically and pragmatically diffcult. In order to standardize civilian ifnancing, the procuratorate should display the responsibility of ifnancial prosecutors and should actively supervise it in open, scientiifc and reasonable way so as to ensure and promote its healthy development.
