| 摘 要： | 刑讯逼供存在于刑事诉讼之中的原因是多方面的:总体侦查水平相对滞后、个别侦查人员素质较低、监督制约机制欠缺和惩处不力。然而从深层次而言,司法人员特别是侦查人员头脑中存在的"口供情结"是产生刑讯逼供的主要原因;"口供情结"也是我国封建诉讼观念和侦查工作现状的必然产物。根治它,仅靠各类"加强"、"提高"措施不行。沉默权的提出,为根治、消除"口供情结"提出了一个全新思路。

| Abstract: | Extorting confession by torture is always a key problem in criminal proceedings. It is caused by lots of factors,such as the backward in investigation technique and the poor quality of a few investigators. Furthermore,Judicial officials have feelings of oral confession, which is the result of old procedural sense and investigatory current situation. Instead of the common measure, adopting the right of remaining silent is a new solution to cure it. |
