| 摘 要： | 随着死刑第二审案件在全国范围内实行开庭审理,以往存在于死刑案件二审审理方式中的三级结构被彻底改变。这顺应了在我国逐步实现对包括死刑案件在内的全部刑事二审案件进行开庭审理的发展趋势。为适应这一趋势,检察机关在刑事二审案件诉讼程序中的职能亟需明确。根据检察机关的宪法定位和诉讼规律,检察机关在刑事第二审中的诉讼职能应当界定为第一审公诉职能和诉讼监督职能的继续和延伸,但重在全方位的诉讼监督。
