| 摘 要： | 污点证人的不受强迫自证其罪权和实践中的利益权衡原则是污点证人豁免的理论基础。污点证人豁免是一种定罪上的豁免,不是量刑上的折扣,也不是辩诉交易的一种。应当在正确的理论基础之上构建我国的污点证人豁免制度。

| Abstract: | Both the privilege against self-crimination of tainted witness and the principle of balancing interests in practice are the theoretical foundation of immunity to tainted witness.Immunity to tainted witness isn't a discount of penalty,but immunity to conviction.Immunity to tainted witness isn't a kind of plea bargain.We should construct the system of immunity to tainted witness in our country based on correct theoretical foundation. |
