论刑事责任量的事实根据

刑事责任量可以分为刑事责任基本量、增量、减量和变量,相应地,刑事责任量的事实根据分为基本量的事实根据、增量的事实根据、减量的事实根据和变量的事实根据。其中,基本量的事实根据是基本构成事实,增量的事实根据是基本构成事实的多余部分和加重构成事实,减量的事实根据是减轻构成事实,变量的事实根据包括变量法定情节事实和变量酌定情节事实两个方面。

The quantity of criminal liability includes essential quantity,enhancive quantity,reductive quantity and mutative quantity.Accordingly,the factual basis of the quantity of criminal liability includes the factual basis of the essential quantity,the factual basis of the enhancive quantity,the factual basis of reductive quantity and the factual basis of mutative quantity.Among these,the factual basis of the essential quantity is the essential facts constituting crime;the factual basis of the enhancive quantity includes the rest proportion of the essential facts constituting crime and the aggravating facts constituting crime;the factual basis of reductive quantity is the alleviative facts constituting crime;and the factual basis of mutative quantity includes two aspects,which are the facts of legal circumstances of mutative quantity and the facts of flexible circumstances of mutative quantity.
