当前贿赂犯罪案件查办中存在的问题及对策

贿赂犯罪作为以谋取利益为目的的犯罪形态之一，其发展和变化总是同社会经济的发展与现状具有必然的联系。改革开放以来，我国的经济体制、经济成份、激励机制和国家机关调控经济的职能手段都发生了深刻而巨大的变化。经济结构的变化必然引起与此相关的犯罪形态的变化，贿赂犯罪的犯罪形态变化体现在犯罪手段、犯罪目的、犯罪数额等各方面。同时由于司法机关对贿赂犯罪的打击力度不断增强，新时期的贿赂犯罪呈现一些新情况、新特点。如何有效遏制贿赂犯罪的发展态势，已成为检察机关在打击职务犯罪上重点关注的问题。

Problems and Solutions in Investigating Bribery Crimes

As a crime for the purpose of making profits,the development and change of bribery has some necessary link with the development and status quo of society and economy.Since the reform and opening up,China’s economic system,economic sectors,incentive mechanism and means of regulating the economy by the state organs have undergone profound and dramatic changes.Changes in economic structure inevitably lead to changes in patterns of crime associated with it,and bribery of crime changes reflected in the criminal means,criminal purpose,the amount of crime and so on.Since China’s legislative and judicial system is not perfect,bribery verification is difficult.How to effectively curb the trend of the development of bribery has become an issue focussed by procuratorate in fighting against duty crimes.
