| 摘 要： | 我国政府历来重视少数民族人权,特别是少数民族文化权利的实现问题.在中央立法层面,从《宪法》、《民族区域自治法》及其若干规定到《文物保护法》,都涉及对少数民族文化权利的保障;在地方立法层面,云南、贵州、福建等省份都有相关的地方性立法对此进行过有益的探索.少数民族文化权利的立法完善主要包括《经济、社会和文化权利国际公约》在国内的适用、《非物质文化遗产保护法》以及《少数民族文化权利保障法》的制定.

The Legislation and Perfection of Safeguarding Cultural Rights of Chinese Ethnic Minorities |

| Abstract: | Chinese government think highly of the realization of human rights of Chinese ethnic minorities all the time,especially cultural rights of Chinese ethnic minorities.In central legislation,from Constitution,Law of Regional Autonomy of Ethnic Groups and its regulation to law for the protection of cultural relics,safeguarding cultural rights of Chinese ethnic minorities is included.In local legislation,Yunnan,Guizhou and Fujian explored it through local regulations.The perfection of safeguarding cultural rights of Chinese ethnic minorities includes execution of ICESCR in China,the legislation of intangible culture and its protection and safeguarding cultural rights of Chinese ethnic minorities. |
