对我国当前再审制度的批判及重构

我国目前的再审制度还存在若干需要完善的问题。应当根据再审程序启动机制的效力来源等因素对目前的再审制度进行全面衡量,取消法院依职权发动再审的程序,理清申请再审与申诉之间的关系,完善检察机关的抗诉监督,进而建立相互协调的再审启动机制。

Critiques and Restructuring of the Current Retrial System

There are some problems that must be solved in our current retrial system.The factors such as the power sources of initiating the retrial procedure must be used to measure the current trail system.The power of courts to initiate the retrial procedure must be cancelled,and applying for retrials and appeals must be distinguished.Meantime,it's necessary to improve the protest power of people's procuratorate,in order to establish the harmonious initiation system of retrials.
