中国公法的崛起与政治变革

本文针对中国公法理论疏于关注公法发展与政治变革关系的不正常研究倾向 ,通过对公法制度与政治制度变革目标的殊途同归、两种制度变革所共同遵循的基本原则、两种制度变革路径选择的相似性、两种制度变革约束条件的相似性等四个基本问题的探讨 ,以期全面展示中国公法崛起与政治体制改革之间的内在逻辑联系 ,推动中国特色公法理论的早日形成。

The Growing up of Chinese Public Law and Political Reform

Against the defects that the Chinese public law research neglects the study on the relationship between the development of public law and political reform, this article explores on four basic issues and suggests that the transformation of public law and political institution shares common goals, fundamental principles, choice of path and restraining conditions. This article tries to unfold the inner logic relations between the growing up of Chinese public law and political reform, therefore to make contributes to the formation of public law theory with Chinese characteristics.
