On the Conflict of the Right of Commercial Name and Trade Mark Right and Its Settlement Mechanism

In this article, the author starts with the basic concepts and nature of the right of commercial names and trade mark right, trying to find some problems from the solutions of the conflict of the right of commercial names and trade mark right, put forward his own views, and come up with a few basic methods and principles for the conflicts of the two rights: regulate the legal position of the right of commercial name, protect the principle of priority, prohibit fraud or misdirection, protect the principle of fair competition and the principle of different protections.
