| 摘 要： | 该文认为，在中国物权法中引入居住权仍有一定的制度价值。文章从居住权的性质、物权原则在中国的实行、规定居住权所能解决的问题等几个方面，对在中国设立居住权制度的问题进行探讨，从而得出居住权在中国具有存在必要性的结论。

| Abstract: | The Property Law of the People's Republic of China was adopted by the National People's Congress in 2007 and will go into effect on October 1,2007.The draft of the law involved considerable controversies,espe- cially over dwelling right.Though dwelling right was referred in the draft version,it is not incorporated in the final- ly approved Property Law.The system of right of habitation has specific functions that can not be replaced by other systems because it coincides with the aim of the Property Law at property protection,the social demands,and the requirement of judicatory practice. |
