| 摘 要： | 上诉权作为被害人的救济性人权,具有公正、秩序、效益及科学民主价值,是被害人所有实体性权利和程序性权利得以实现的保障。赋予被害人上诉权具有充分的理论和实践根据。但是,必须完善相应的刑事诉讼制度,才能保障被害人上诉权实现。

| Abstract: | As a remedying human right of victims, the appealing right has the value of justice, order, efficiency, science and democracy. It is the protection of all the substantive and procedural rights of victims. There are sufficiently theoretical and practical grounds for giving the victim's appealing right. But only when we complete relevant criminal procedure systems can we safeguard the realization of victim's appealing right. |
