诱惑侦查实施原则研究

目前，我国侦查机关已经广泛使用诱惑侦查侦破各类刑事案件，要针对其在实施的策略方法中容易出现的问题，制定相应的规范，从而保证其在合理、合法限度内尽量发挥最大作用。实施过程中，应遵循以下四项基本原则：合法保密、审查监督原则；周密设计、适时终止原则；掌握情势、控制进程原则；即时取证、固定证据原则。

A Study on Implementation Principles of Enticement Investigation

Recently in China, investigation organs have been widely employing enticement investigation in various criminal cases. Meanwhile, it is crucial to make rules in case of tactic problems in order to ensure its best use justifiably and legally. In implementation of enticement investigation, four principles are obeyed： the investigation is legally confidential and supervised; it follows cautious scheme and timely termination; takes whole control of situation and takes orocess in charge, obtains evidence promptly and then reserves evidence.
