| 摘 要： | 期待可能性理论是刑法理论研究中的重要问题,在许多大陆法系国家和地区的刑法理论中占有相当重要的地位。在我国刑法理论中,期待可能性宜作为刑事责任的构成要素,在责任论中论述。期待可能性的判断应以行为人为标准。超法规的期待可能性应适用于一切过失犯罪和某些故意犯罪。

| Abstract: | The theory of anticipated possibility is an important problem in the study of the theory of the criminal law, it holds an important position in the theory of criminal law in many countries civil-law and districts. According to our country's theory of criminal law, anticipated possibility is an element of criminal responsibility. The anticipated possibility should be judged according to the actor's standard. The anticipated possibility out of norm should be used in all negligent occasions and some voluntary occasions. |
