论我国农村集体经营性建设用地流转制度的构建

摘    要:改革现行土地管理制度,创设农村集体经营性建设用地法律制度,一要明确农村集体经营性建设用地所有权的权属及权能内涵,允许其依法出让、租赁、入股;二要规范农村集体经营性建设用地流转的条件、方式和程序,做到合法合规、公开公正、运行有序;三要建立兼顾国家、集体、个人的土地流转收益的分配机制,明确分配主体、控制分配比例、监管收益用途;四要建立城乡统一、平等入市、同权同价的建设用地市场,完善土地登记制度、定级评估制度和价格管理制度.

Abstract:To reform the current land administration institution, to construct the legal system of countryside collective operational constructive land, the following tasks must be conducted : to ensure the proprietary rights of the countryside collective operational constructive land, allowing it to be legally sold, rent and stocked; to normalize the circulation condition, approaches and procedures of the countryside collective operational constructive land; to construct a distribution system overall considering the nation, community and the individuals, to ensure the distri- bution participants, the rates and the profits'usage; and to form a operational constructive land market by improving the registration system and price administration system.
