| 摘 要： | 公司取得自有股份的行为通常会涉及到公司自身、股东和债权人之间的多重利益。我国现行公司法中对这一制度的规定相当薄弱,在一定制度上影响到公司制度作用的发挥。我国未来公司法中的公司取得自有股份制度应在范围、资金来源、取得方式等方面进行修正与完善。
