| 摘 要： | 前科制度作为一项重要的刑法制度 ,只有在服刑罪犯存在人身危险性时才具备存在的意义 ,单纯以所受刑罚的轻重为适用标准有一定的缺陷 ;前科应与累犯制度区别开来 ,不应具有定罪效应 ,前科的功能在于限制行为人的资格或权利以达到防卫社会的目的 ;前科应该有存在的期间 ,前科消灭的期限要有利于改造行为人 ;我国应该承认前科制度 ,并完善其消灭机制。

| Abstract: | This article analyses some of the main issues of criminal record system .The criminal record shall be adopted as a result of personality danger and the pure punishment standard is not scientific. It should be differentiated from recidivate which has no direct effect on conviction. Its main function is to deprive the doer's certain civil qualifications. It needs time limits. We should acknowledge criminal record system openly,and establish its cancellation system. |
