论《唐律疏议》中见危不救行为及其立法启示

以广东小悦悦事件为代表的众多见危不救行为,在全社会造成了恶劣的影响,引发了社会对见危不救行为的关注。对见危不救行为是否可以纳入刑法处罚的范围、如果可以纳入刑法处罚的范围,我们应该在立法上注意什么样的问题成为当前刑法学界亟需解决的现实热点问题。本文试通过历史研究的方法,以《唐律疏议》中对见危不救行为的相关立法为切入点,并结合当今我国的实际情况,建议将见危不救行为入刑,并从犯罪客体等四个方面提出了具体的立法意见以及在立法中应注意的事项。

On the Indifferent Behavior to Others in Danger in Tang Lv Shu Yi and Enlightenment in Legislation

In recent years,many indifferent behaviors to others in danger represented by little Yueyue event in Guangdong had very bad influence on the whole society,which has caused the attention of society.One of the realistic and heated problems to be solved urgently in the field of Criminal Law is whether the behavior should be brought into the scope of punishment or if so,what kind of problems should be paid attention to in legislation.Taking related laws to indifferent behavior to others in danger in Tang Lv Shu Yi（Codes of Tang Dynasty） as the key point in the expectation of drawing lesions from history and making the past serve the present by the method of historical research,this article suggests to bring the indifferent behavior to others in danger into the Criminal Law and puts forward specific suggestions from the object of crime and matters needing attention in legislation.
