| 摘 要： | 基本权利是公民最重要的权利,对公民基本权利的保障关系到公民宪法地位的实现程度。长期以来我国是通过法律对公民的基本权利具体化的方式来保障公民基本权利,这一保障方式与基本权利的性质是不相适应的,需要提升为依据宪法的保障。加强对公民基本权利的保障,需要通过建立违宪审查制度实现。
