以《鹿特丹规则》为视角,分析新型的制度建构对提单物权凭证功能的传承,并在新公约的语境下对提单的物权凭证功能进行初步解析,指出在未来的海上运输法研究领域,提单的物权凭证功能仍是一个重要的研究课题。

Analysis of the function of the document of title under the B/L at the visual angle of the Rotterdam Rules

In this paper,a study is made at the visual angle of Rotterdam Rules on the inheritance of the function of B/L and a primary interpretation of the same is also made in the context of the new convention.It is pointed that in the research area of the law of carriage of goods by sea in future,the function of the document of title of B/L shall still be one of the important subject to be conscientiously researched.
