当代中国法制的阶段性与超越性——与19世纪英美法制之比较

目前我国的经济发展水平大体上相当于19世纪的英国和美国。当时英美两国的法制发生的六个主要变化,正是我们研究当代中国法制能否超越19世纪英美法制发展水平的重要参照系。实践表明,凡是主要靠法律理念变革来实现、而不靠或者较少靠经济发展和国家经济实力来实现的法制项目,中国则可以超越19世纪英美法制的发展水平;凡是主要靠经济发展和国家经济实力来实现的法制项目,中国则没有超越英美法制的发展水平。因此,法制最终只不过是经济关系的记录而已。

The Transcendence and Transition of Current China's Legal System

Current China's economic development level approximately equals to that of Britain and America in 19th century.Then these two countries experienced six major changes in their legal system,which is a important parameter in studying the development speed of China's legal system.Experience shows that China may overstep Britain and America of 19th century in those areas in which changes were realized by legal idea's change,and China does not surpass those two countries in those areas in which legal system's development mainly realized by economic development and national economic strength.There fore,legal system is just a record of economic relation.
