民意与法意的碰撞与耦合——以检察机关和舆论媒体的互动与应对为视角

在渐成气候的媒体时代,检察机关和舆论媒体形成了既相互影响又相互制约的共同体,因为舆论媒体有其独有特点以及检察机关与检察权的特有运行方式,导致舆论的道德法庭与检察权的独立运行之间存在一定的冲突与失范。为了寻求解决之道,应从双方互动存在可行性,舆论媒体应尊重和监督检察机关,检察机关应回馈与引领舆论,舆论媒体监督与检察权运行的辩证统一的关系等方面加以考虑,最终使检察权独立性得以维护,司法公正得以彰显,司法责任得以落实。

Collision and Coupling of Public Opinion and Law——From the View of the Response and Interaction between Procuratorial Organs and Public Opinion Media

In the media era, procuratorial organs and media form communities both mutually effect and restrict, because the media has its unique feature as well as special operation mode of the procuratorial organ and procuratorial power, leading to certain conflict and anomie between public morality court and independent procuratorial power. In order to seek the solution from the mutual existence, fea- sibility, the media should respect and supervision of the procuratorial organ, procuratorial organs should feedback and lead the public opinions, so it is necessary to consider the dialectical unity relationship of public opinions of media supervision and procuratorial power and other aspects. Thus safeguarding the procuratorial independence ,manifest judicial justice to fulfill Judicial resnonsibilitv.
