| 摘 要： | 通过对中西法律文化的分析比较可以看出,旧中国无法实现真正意义上的法治。在新中国社会主义制度创新的过程中,法治建设必不可少。但是由于缺乏民主的基础和法治的土壤,中国只能走政府推进型道路。

| Abstract: | The article concluded that there was not real rule by law in old society of China from comparing legal culture of China with the west.Construction of rule by law is necessary during the period of system innovation of socialism.Being lack of the base of democracy and the soil of rule by law,China could only select the type of government advancing. |
