论行政审批中的"越位"、"错位"和"缺位"

行政审批改革是行政管理改革的重要内容 ,我国当前的行政审批存在着严重的“越位”、“错位”和“缺位”现象。双轨制的存在、权力利益的部门化和个人化、法律法规的不健全及传统观念的顽固存在是导致行政审批当中不合理现象和错误做法的主要原因。应当通过加快立法、大力发展中介组织、积极借鉴中外行政管理的先进做法来消除这些弊端。

Study of "Offside", "Dislocation" and "Omission" Phenomena in Administrrative Examination and Approval

As there are "offside","dislocation"and"omission"phenomena in examination and approval, China's system of administrative examination and approval should be reformed. Existence of the double-track system, sectionalization and individualization of the interestes brought by power, imperfect laws and regulations and traditional concepts result in the above maladies. The ways to solve the problems are to step up legislation, devote major efforts to developing intermediary organizations and actively use the experiences of other countries for reference.
