诉讼系属中债权转让时 ,债务人对受让人的抗辩与反诉 ,由于我国现行立法无明文规定 ,致使司法实践中认识不能统一 ,存在诸多问题。本文论述了诉讼系属中债权转让时 ,债务人对受让人的抗辩与反诉在诉讼承受主义和当事人恒定主义不同模式下的主要内容、立法政策、处理程序等有关问题 ,以期对完善我国民事诉讼法有所裨益。

Counterplea and Countercharge of Debtor for Assignee in Pending Actions

There is no stipulation of counterplea and counterclaim which debtors resist assignees when creditor rights are transferred in pending actions in the present legislations,we can not reach a common understanding in judicial practice,so there are many problems. The paper discusses some relative question of defense and countercharge of debtors for assignees under different patterns of formalization of parties or inheritance of litigation such as legislative policies and handling proceeding while creditors' rights are transferred so as to contribute to the perfection of the civil lawsuit
