浅议赃物能否适用善意取得

赃物是否适用善意取得制度,目前我国现有的法律中没有明确规定,这必然给司法实务中处理此类问题带来诸多困难。因此,本文试从赃物的概念入手,通过对国外关于赃物善意取得的立法例、我国相关立法和学说进行分析,提出赃物有适用善意取得的空间,从而平衡财产权利的动态保护和静态保护,实现物权公示公信原则和民法公平原则的和谐统一。

On Whether the Furtum Conceptum Being Applied with Obtaining in Good Faith

Whether the furtum conceptum can be applied with obtaining in good faith is not clearly defined in China’s existing laws,which has caused many difficulties to deal with such issues is bound to in the judicial practice.Therefore,this paper try to start from the concept of furtum conceptum,through the foreign enactment of legislation,the relevant legislation and doctrine,put forward the space whether the furtum conceptum is applicable to obtaining in good faith,to make the dynamic balance of property rights protection and its static protection,to achieve the civil harmony and unity of the property public trust principle and fairness of the civil law.
