国际私法功能的演变

本文利用语义分析和历史分析的研究方法,界定国际私法功能的涵义,即国际私法通过直接或间接的调整方法,确定涉外民商事法律关系的准据法,确立当事人的权利与义务,从而保护当事人的合法权益,保障涉外民商事交往的顺利进行。在此基础上,论述了近10年国际私法功能的演变,并分析了国际私法功能变化的原因。最后就国际私法在我国现阶段的作用进行了探讨。

The Change of the Function of Private International Law

The article defines the function of Private international law, which determines the applicable law of civil and business relations including foreign factors, affirms the right and obligation of the parties, protects the legal benefits of the parties and safeguards the process of the foreign civil and business association. On this basis, the article discusses the change in the function of Private international law in the past decade and analyses the cause of the change. Lastly, the article probes into the role of private international law in our country.
