| 摘 要： | “因逃逸致人死亡”的结构分析是正确理解和认定交通肇事逃逸案件的基础。自97《刑法》颁行以来，对其第一百三十三条之所以争论不断，实践的复杂性和理论上对其主客观方面的认知不够明确是一个重要原因。因此，有必要对其从主客观构造体系、立法背景等诸方面进行阐释。

| Abstract: | Structural analysis of "death resulted from absconding" is the foundation to correctly understand and affirm the case of hit-and-run traffic accident.From 97 Criminal Law was issued for enforcement,there are a great deal of controversy about provision 133,the main cause is that the complexity of practice and the cognitive uncertainty to the objective and subjective aspects of the crime.Therefore,it's necessary to clarify the objective and subjective aspects and the legislative background of this crime. |
