| 摘 要： | 文章阐述了马克思晚年人类学笔记所体现的法律思想和理论进展 ,揭示了传统东方法律文化所固有的三条逻辑规律。在此基础上 ,对中国社会法律的运用进行了现实的透视并从文化的视角入手进行了分析 ,指出应从文化的角度来阐释法律 ,才能实现传统法律文化的创造性转化和本土法律资源的合法化 ,最终在这种纵向与横向的嬗变中为中国法律文化找到最佳的坐标。

| Abstract: | The article deals with the legal idea and theory expressed in the anthropology notebooks at the twilight years of Marx. It reveals 3 logical rules taken up by traditional eastern legal culture. Moreover, the article reviews the use of law in China, analyzes it and points out that the law is to be interpreted in view of culture to change the traditional legal culture creatively and legalize the local legal resources, and find the best location of Chinese legal culture in the change. |
