| 摘 要： | 交通违法处罚的目的是通过处罚的手段达到更有序的状态,作为行政处罚中的一种,应严格依照《行政处罚法》的规定执行,违法处罚应符合《行政处罚法》的基本原则。无论现场执法还是非现场执法,其处罚程序均要公正、公开,并体现处罚与教育相结合。依靠“电子警察”执法有利有弊。应区分行政处罚的手段与目的,人机结合,杜绝以罚代管。
