| 摘 要： | 对法律义务冲突的探讨就是为了给法律义务冲突的解决提供可资参考的方法和建议。既有的解决方向只要求在冲突的法律义务中选择一个适宜的法律义务履行,就可能阻却因没有履行另一个法律义务而造成的违法或者应承担的责任。既有的基本解决原则是对冲突的法律义务在价值上排列顺序,履行一个价值高(或相等)的法律义务是舍弃另一个价值低(或相等)的法律义务并免除相应责任的正当理由。不论是既有的解决方向,还是既有的解决原则都存在值得我们反思之处。

| Abstract: | The exploration to the conflict of legal obligation is to provide the methods and recommendations to settle the conflict of legal obligation.The existing direction of resolving conflict only required us to fulfill by choosing an appropriate one among the conflict legal obligations which might stop the subject from taking the responsible because of the failure to carry out another legal obligation.The existing basic principle is to take the conflict legal obligation in order according to the value of a legal obligation.Performing a legal obligation of high value (or equivalent) is a justified reason to give up another legal obligation of low-value (or equivalent) and to remove the responsibility.There are some points worth rethinking in both the existing direction and the existing settlement principles. |
