法律解释的批判性分析

法律解释是一种依据法律而进行的法律思维活动,属于法律方法的范畴。不同的主体在不同的场合进行基于不同需求的法律解释活动,是否与个案的司法裁判活动有关为标准,可以将法律解释的主体和场合分为法官、参与案件的当事人和诉讼代理人以及未参与案件的普通公众和法学者;法律解释的对象应是法律文本,而不是法律规范或法律条文;法律解释“产品”应是审判规范,而不是法律规范;法律解释的外延应包括对法律文本意义的理解和说明,而不仅仅是对法律文本的解释。

A Critical Analysis On Some of the Opinions about Legal Interpretation

If we want to get an overall understanding of legal interpretation, we must discuss in thefollowing aspects , i.e. when we are interpreting the law , what we are interpreting , what we can get throughinterpreting, and the connotation of legal interpretation. Otherwise, our definitions cannot be rational .In thisarticle, the author also has an opinion that, although other scholars' understanding of legal interpretation arereasonable to some degree, their definition of legal interpretation aren't accurate at all. Thus, there exists somedominantdeflectsintheirtheories,whicharebasedoninaccuratedefinitionofbasicconcepts.
