试论犯罪的加重形态

在我国刑法规定中,存在着大量复杂的犯罪构成模式,刑法据此规定了不同档次的法定刑幅度,以体现罪刑相适应的原则。加重形态实质上属于犯罪派生构成模式。只有从不同角度对加重形态进行深入研究,将有关的法律规定提高到理论上加以说明,才能使审判人员在实践中更好地运用它们进行科学的定罪,为合理量刑奠定基础。
