论规范分析方法

规范分析方法是法学特有的方法,但是这种方法迄今为止都没有在中国法学界获得应有的位置,得到应有的重视,这一是因为中国法学自身研究对象模糊从而不足以支持法学方法的正常发展,另一方面是因为中国法学自身缺乏学科自主性。规范分析方法主要关注法的合法性、法的运行效果、法的实体内容,全方位考察法的构成要素,由此制度事实构成规范分析的对象。

On Normal Analysis Method

Norm analysis is the own approach of Law,but this approach doesn't find its proper position in Chinese Juristic Academe nor was thought much by the Chinese Juristic Academe.One reason is that the Chinese Juristic Academe does not have a clear concept about the research object,which has a bad result on the development of methodology of the Law.The other reason is that the Chinese Juristic Academe lacks of self-determination.As the traditional approach of western Law,Norm analysis concerns on validity,result of function and noumenon of law.Norm analysis has a all-sided view on the structural factor,so its main study object is institutional fact.
