论职务犯罪的现状及防治路径

作为腐败现象最极端的表现形式,职务犯罪近年来日益猖獗。当前,虽然国家对职务犯罪的打击力度不断加大,学界、实务界对职务犯罪的研究也有了新的突破,但有关职务犯罪的个别化、特殊化的研究,还显浅薄。当前职务犯罪的现状是:贪污贿赂等贪利性犯罪是职务犯罪主要的犯罪形式;案件具体情况逐步发生变化;职务犯罪向相关领域逐步蔓延。而防治职务犯罪的路径是:在立法上完善对职务犯罪的防控,从制度上建立高效的廉政体系,在战略上坚持惩治的原则,在战役上要立足兼治的原则。

The prevention paths are as follows： 1. to perfect the legislation on the crime of taking advantage of duty; 2. to establish an efficient clean and honest administration system; 3. to adhere to the principle of punishment strategically; 4. to base ourselves on the principle of concurrent administration.
