| 摘 要： | 2008年以来,索马里、亚丁湾海域海盗活动猖獗,联合国安理会为此多次作出决议,十几个国家派出军舰在该水域为商船护航,但是该国际航运水道的安全形势并未根本好转。索马里国内长期社会动荡是滋生海盗的内部原因,惩治海盗犯罪的国际刑事法律制度功能缺失是现代海盗活动蔓延的外部条件。联合国安理会应当出台标本兼治的措施,推动索马里实现国内和平,并且积极倡导完善有关的国际刑事法律制度,推动成员国修改本国刑事法律以实现各国国内法律在打击海盗犯罪场合与有关国际条约有效衔接。

| Abstract: | Since 2008,pirate activities have been rampant in Somalia and the Gulf of Aden.Untied Nations Security Council has made many resolutions against them and a dozen of countries and the European Union have sent warships to guard merchant ships in this water area.However,the situation in the international shipping channel has not been fundamentally changed for the better.The long existing social turbulence in Somalia is the internal cause for pirates and the loss of function of international criminal law system... |
