民愤与刑事司法

法律,国家稳定的基石,法治的根本;民愤,只不过是一种民间情绪而已。从表面上,法律是法律,民愤是民愤,二者似乎毫无关系。但从最近的许霆案,到张金柱案、黄静案、刘涌案、佘祥林案,邱兴华案等案件中可以看到,民愤都扮演了极为重要的角色。民意无意间成了左右审判,铸造冤案的祸因之一,不能不引起我们的警惕。不怪乎有人质疑法律的严肃性和权威性。因此,重新审视刑事司法中的民愤似乎显得尤为重要。
