| 摘 要： | 间接正犯的成立范围主要是由被利用者行为的范围决定,即被利用者的哪些行为能够被幕后者用作实施犯罪意图的工具。间接正犯中的工具行为应当具备＂非正犯性＂和＂可支配性＂两个条件。
