论入世与中国行政立法司法审查制度之完善

对于中国而言,“入世”的过程与其说是经济与世界接轨的过程,还不如说是政府行为与世界接轨的过程;WTO规则与其说是市场规则,还不如说是政府规则;而任何形式的政府规则,都应当导向于这样一个共同的目标,那就是法治政府,或者说,有限且有效政府。从司法审查与行政立法、WTO与行政立法的司法审查以及建立与WTO要求相适应的司法审查制度等三个层面对WTO与中国行政立法的司法审查进行探讨。

On the Entry to WTO and the Perfection of China's Judicial Review System

The process,to China,is not so much one in which economy gets consistent with the world as one in which governmental behavior becomes consistent with the world,and WTO rules are not so much market rules as governmental rules.Any types of government rules, however,should lead to a common target,that is,government of rule of law, or government that is limited and effective.The thesis mainly discusses on judicial review and administrative legislation,WTO and the judicial review of administrative legislation,the built of judicial review system consistent with WTO.
