| 摘 要： | 商业秘密是指不为公众所知悉,能为权利人带来经济利益,具有实用性并经权利人采取保密措施的技术秘密和经营秘密。商业秘密的侵权行为有四种表现形式和三条认定标准。认定商业秘密的侵权行为时应注意例外情形以及法律责任的竞合。

| Abstract: | The dissertation starts with the basic theory of trade secrets,analyses the legal definition of trade secrets and the constitutive requirements of trade secrets.The behaviors transgressing the trade secrets can be divided into four fundamental types.Last,on the base of reviewing the well-rounded experience of legislation and practice about protection on trade secrets in international organization and main developed country,the paper parses our national legal protection on trade secrets at present and its matter. |
